GRAPE FUTURES TERMS AND CONDITIONS OF SALE

GENERAL

  • All grape orders, fresh or frozen, are payable in full at the time order is placed, unless special arrangements have been made. A grape order will not be considered final until payment is received.
  • Payment for grapes signifies your acceptance of these “Terms and Conditions of Sale”.
  • Prior to pick up or shipping of your order, all freight and other charges by Brehm Vineyards must be paid-in-full.
  • Prices are final only after grapes have been harvested.
  • Unharvested grapes are assigned priority numbers determined by date of order. First come, first served protocol will be used in filling orders. If there are insufficient grapes to satisfy an exisiting order, Brehm Vineyards, at the clients discretion, will refund monies paid or apply these funds to other grapes.
  • Some grapes have been and will probably be harvested at higher sugars than 24° brix. The buyer understands that this condition does exist. High sugar is not grounds for objecting to the grapes' quality.
  • Purchasing by weight and selling by volume does not offer an incentive for high sugars; higher sugar more weight/gallon.
  • All grapes grown in Washington or Oregon are priced f.o.b. Underwood, WA or Northwest Freezer.
  • All grapes grown in California are priced f.o.b. Richmond, CA or Petaluma, CA.
  • Grapes are an agricultural product and are subject to price variation and availability.

FRESH GRAPES AND JUICE ORDERS

  • Fresh Black Grapes are sold per pound as whole bunches with stems: Minimum order 100 lbs.
  • Arrangements for de-stemming grapes should be made at time of purchase. Stem weight is calculated at 6%. Each 100 lb. of black grapes that are ordered and stemmed will yield 94 pounds of destemmed grapes.
  • De-stemmed ”must” will be charged $150 per ton or $0.075 per pound. Destemming may not be available at all times.
  • All Fresh White Grapes in California are sold as settled juice: Minimum order 5 gallons.
  • A limited selection of Fresh White Grapes in the Northwest may be sold per pound as whole bunches: Minimum order 100 lbs. All Fresh White Grapes in the Northwest are sold as settled juice. Minimum order 5 gallons.
  • All Fresh Grapes are sold net, without containers and/or storage.
  • It is not possible to predict the exact date of harvest and availability for pick up of fresh grapes/juice. It is the responsibility of the customer/buyer to make sure that we have adequate information to reach you by phone at home and work. If available, please also provide us with an email address. If there is any possibility you will be unavailable, please designate an alternate person, with appropriate phone numbers, to receive your grapes. If you determine that you will not be available to pick up fresh notify us ASAP.

FROZEN GRAPE ORDERS

  • Frozen Black Grapes, de-stemmed, are sold by volume in U.S. gallons and pounds (5 U.S. gal./425 lbs.).
  • Frozen White Grapes are sold as settled juice, by volume (20 liter pails and 46 US gallon drums).
  • For frozen grape orders, shipping and handling costs will be determined and billed prior to shipping or pick up.

FROZEN STORAGE CHARGES

California & Northwest Freezers:

  • Frozen Futures Orders prices from the 2010 harvest year include frozen storage through December 31, 2010. Customers whose frozen Grapes/Juice are in these California or Northwest facilities past December 31, 2010 will incur a $5 per pail or $50 per drum for an additional 30 days of frozen storage. If the order still has not been shipped or picked up within these additional 30 days, the order will incur a second charge of an amount at the discretion of Brehm Vineyards. If a grape order has not been shipped or picked up within 60 days of the initial standard storage period, at the discretion of Brehm Vineyards, those grapes may be removed from Brehm Vineyards control or put back into Brehm Vineyards' inventory. If the grapes are put back into BV's inventory the purchaser will receive a sum equal to 50% of the initial grape price, minus any amounts due.


FROZEN STORAGE CHARGES ARE SUBJECT TO CHANGE WITHOUT NOTICE.


PICK UP

  • Freezer facilities require a minimum of two working days' notice to prepare your grapes for pick up. Please notify Brehm Vineyard's at least 72 hours, or 3 working days, prior to desired date of pick-up. You will also need to call the freezer and schedule an appointment time.

SHIPPING

  • Peter Brehm/Brehm Vineyards' responsibility for the integrity of the product ends once the grapes leave his control.
    Shipment of grapes and/or juice by air cargo, truck or commercial carrier, less than truck load or full truckload under contract with Peter Brehm or customer(s) are “out of the control” of Peter Brehm/Brehm Vineyards. If grapes/juice are delivered in unsatisfactory condition: all defects, losses, any damage must be written on the Bill of Lading, or Air Waybill, acknowledged and signed by the driver or airline agent, and notification provided to Peter Brehm/Brehm Vineyards within 36 hours.

  • When shipping arrangements are made and prepaid by Brehm Vineyards (truck or air cargo), a $45.00 shipping and handling fee will be charged. This fee applies to one person shipping to one location. No fees are charged when a customer makes his/her own shipping arrangements and pays the carrier for the shipment directly from the freezer.

  • Grapes frozen in Richmond, CA and shipped to the Northwest, or vice versa, to consolidate a load, or assist in shipping in some other way, will incur transfer charges. The cost of these transfer charges will be made at the time of shipment. For more information on shipping, please call the office or review the shipping section on our website.

  • Payment may be made by check, cash, or credit card. We accept MasterCard and Visa.
